By listing your accommodation property on the
Travel NSW web site, you must agree to the following terms and conditions.
- We accept your advertisement in good faith. Any claims or objections that arise in respect to your content on Travel NSW must be borne upon yourself. Travel NSW will not be held responsible for any advertiser content unless it is obviously clear that it breaches state, federal or international laws.
- Any wording, photographs or other material that you supply to us in order to publish your accommodation listing on the Travel NSW web site must either be content that you hold the copyright for, or content that you have gained permission for us to reproduce on the Travel NSW web site. We will not be held responsible for copyright claims that may arise from supplying us with unauthorised information or photographs which we have published in good faith. Sole responsibility for this rests with the advertising party.
- We reserve the right to refuse any advertising application if we believe that the property wishing to be advertised is inconsistent or out of character with the contents of the Travel NSW web site, or if we have doubts about a particular advertiser's ability to pay advertising costs.
- The addition of new accommodation listings or updates to existing accommodation listings will endeavour to be implemented as a matter of high priority. However, while the majority of additions or changes are done within 48 hours, Travel NSW makes no guarantee that this level of turn around time will be achievable in every situation.
- If your accommodation property is not located within one of the towns, cities or suburbs that are currently featured on the Travel NSW web site, there may be up to about a week delay in processing your application while we research and develop a tourism profile for your area.
- Due to the time and expenses initially required to create your advertisement, after you submit the request to list your accommodation and a preview of your advertisement is sent to you, you are then liable for the cost of the first year of advertising. Continuing the advertisement in subsequent years (i.e the second year onwards) is then on a year by year basis and completely up to the advertiser as to whether they wish to proceed each year.
- If you sell your property during your advertising period, the advertisement is transferred to the new owners, assuming they will be continuing to run the property as guest accommodation. The advertisement will run its full course as originally paid for, irrespective of ownership changes. However, if there is an ownership change, you must advise us of it so we can update our internal records.
- If you need to discontinue your advertisement due to unforeseen circumstances beyond your control, a partial refund of your advertising fee is available. This refund equals the non-GST component of the annual advertising fee adjusted to span the unused period of advertising, minus a $10 administrative fee. Refunds are not available if you sell your property (you can transfer your advertisement to the new owner - see above) or if you voluntarily choose to close down.
- At any stage, you can request that your advertisement be temporarily suspended from appearing on the Travel NSW web site. This may be relevant if the property will be unavailable for a lengthy period, for example due to renovations or due to the owners/managers being away. Any remaining time left in your advertising period is placed in credit and can be used when your advertisement is reactivated.
- We reserve the right to suspend or remove any advertisement that has not been paid for by the due date stated in the invoice issued.
- We reserve the right to make minor changes to your advertisement at any time in order to maintain a certain level of quality and consistency. These minor changes will be limited to correcting punctuation and spelling mistakes, fixing grammatical errors and the general layout of information within your advertisement.
- If you have an official "star rating" from AAA Tourism, you are welcome to make mention of it within your accommodation listing on Travel NSW. However, under no circumstances will we display a star rating that no longer applies, is out of date or is one that you have assigned yourself.
- It is your responsibility to ensure your advertisement on the Travel NSW web site is up to date. That includes details such as the facilities offered, pricing, current STAR rating (if you have one), photographs, phone number(s) and email address. By advertising with us, you agree that Travel NSW will not be held responsible for the consequences of displaying out of date, inaccurate or misleading information that you have provided within your advertisement. Please contact us at any time to notify us of changes required to your advertisement, and we will promptly attend to it.
- If you provide an email address to be displayed within your advertisement which allows potential guests to contact you via email, then it is your responsibility to ensure that email address is functional. Please contact us at any time if you require changes to your listed email address. We will not be held responsible for lost emails if the email address you have provided us with is incorrect, is not accepting new emails due to a quota being exceeded, or you have spam filters in place which are causing the enquiries sent to you being classified as junk or discarded.
- While the Travel NSW web site is visited by many thousands of people every year, this in no way guarantees that you will receive a certain number of enquiries or bookings from your listing. Many different factors can affect the level of feedback you get from your advertisement, including the location of your property, its facilities, the quality of photographs, pricing, the time of year, demand, supply, weather conditions and publicity.
- Providing Travel NSW with your postal address, email address, FAX number or telephone number gives us permission to use any or all of those methods to contact you in regards to your advertisement while it is published on the Travel NSW web site.
